1. Acceptance Of Terms
These Terms & Conditions ("Terms") govern your access to and use of the website netskart.com (the "Site") and the purchase of any products sold under the ProNet® brand operated by Reach Netting Solutions Pvt. Ltd. under the name Netskart ("we", "us", "our").
By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms, our Privacy Policy, Shipping Policy, and Return & Refund Policy. If you do not agree, please do not use the Site.
Marketing And Analytics Consent
By placing an order, creating an account, submitting a form, or confirming checkout on Netskart, you consent to Netskart using the information provided by you, along with your order history, browsing activity, and interaction data, for order processing, customer support, website improvement, product recommendations, analytics, remarketing, and promotional communication through channels such as WhatsApp, SMS, email, phone, Google, Meta, and other advertising or communication platforms.
You may opt out of promotional communication at any time by contacting us at contact@netskart.com or by using the unsubscribe/opt-out option where available.
2. Eligibility
You must be at least 18 years old and legally competent to enter into a binding contract under the Indian Contract Act, 1872 to place an order. By placing an order, you represent that you meet these requirements.
3. Your Account
- You are responsible for keeping your account credentials confidential.
- You are responsible for all activities that occur under your account.
- You must provide accurate, current, and complete information when creating an account or placing an order.
- We reserve the right to suspend or terminate accounts that violate these Terms or that are suspected of fraudulent activity.
4. Products & Descriptions
We make every reasonable effort to display product specifications, dimensions, materials, and colours as accurately as possible. However:
- Net colours, mesh appearance, and weave details may vary slightly on your screen depending on display settings.
- Custom-size nets are made to order as per the dimensions provided by you. Minor finishing or measurement variation may occur due to cutting, stitching, folding, and packing processes.
- Specifications such as thread thickness, mesh size, weight, and strength are provided for general product guidance. Minor manufacturing variations may occur depending on material batch and production process.
- Product availability is not guaranteed and we may discontinue, modify, or update any product without prior notice.
5. Pricing & Payment
- All prices are in Indian Rupees (₹) and inclusive of applicable GST unless stated otherwise.
- Prepaid orders qualify for free shipping. COD shipping charges, if applicable, are displayed at checkout based on payment method and order value.
- We reserve the right to change prices at any time without notice. The price applicable to your order is the one shown at the time of order confirmation.
- Pricing errors: if a product is listed at an incorrect price due to typographical, technical, or human error, we reserve the right to cancel the order and issue a full refund.
- Payment methods: UPI, debit cards, credit cards, NetBanking, popular wallets, and Cash on Delivery, subject to eligibility and order value limits stated in the Shipping Policy.
- All online payments are processed by PCI-DSS compliant payment gateways. We do not store full card or UPI credentials on our servers.
6. Order Acceptance
Placing an order on the Site constitutes an offer to purchase. The contract of sale is concluded only when we accept your order by sending an order confirmation.
We reserve the right, at our sole discretion, to refuse or cancel any order, including but not limited to cases of:
- Product unavailability or stock-out
- Errors in product or pricing information
- Suspected fraudulent activity
- Non-serviceable pincode
- Violation of these Terms
7. Shipping & Returns
Shipping timelines, charges, and reverse-pickup terms are governed by our Shipping Policy. Returns, refunds, and cancellations are governed by our Return & Refund Policy. Both policies form part of these Terms.
8. Intellectual Property
All content on the Site, including text, images, logos, product photographs, illustrations, the ProNet® mark, Netskart name, site design, code, and database structure, is the property of Netskart or its licensors and is protected under Indian and international copyright, trademark, and other intellectual property laws.
ProNet® is a registered trademark. Netskart is used as the website and communication name. You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any of our content without our prior written permission.
9. User Content & Reviews
When you submit reviews, ratings, photos, comments, or any other content to the Site:
- You grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, reproduce, and adapt that content for our business purposes, including marketing.
- You warrant that the content is your own, accurate, and does not infringe any third-party rights.
- You agree not to submit content that is unlawful, obscene, defamatory, misleading, or otherwise objectionable.
- We reserve the right to remove any user content at our discretion without notice.
10. Prohibited Uses
You agree not to:
- Use the Site for any unlawful, fraudulent, or harmful purpose
- Attempt to gain unauthorised access to our systems, networks, or other users' accounts
- Interfere with the operation of the Site, including by introducing viruses, malware, or excessive automated requests
- Scrape, harvest, or otherwise collect data from the Site without our written permission
- Impersonate any person or misrepresent your affiliation with any person or entity
- Use our trademarks or content in any manner not expressly permitted
11. Warranty & Disclaimer
Product life mentioned on the website or product page is an estimated usage life based on normal conditions. It may vary depending on usage, installation, weather exposure, maintenance, and handling. Netskart does not provide any separate warranty unless specifically mentioned in writing for a particular product.
Disclaimer
Except as expressly stated, the Site and the products are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the maximum extent permitted by applicable law.
12. Limitation Of Liability
To the maximum extent permitted by law, Netskart and its directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of the Site or any product, even if we have been advised of the possibility of such damages.
Our total aggregate liability in respect of any claim arising out of or relating to a product or order shall not exceed the amount actually paid by you for the relevant product.
Nothing in these Terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.
13. Indemnity
You agree to indemnify and hold Netskart, its directors, employees, and affiliates harmless from any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or relating to:
- Your breach of these Terms
- Your misuse of the Site or products
- Your violation of any third-party rights or applicable law
14. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or the use of the Site or products shall be subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan.
Before commencing any legal proceedings, the parties agree to attempt good-faith resolution by raising the matter with our Grievance Officer; see Section 16.
15. Changes To These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Material changes will be notified via email or a prominent notice on the Site at least 7 days before they take effect. Continued use of the Site after the effective date constitutes acceptance of the revised Terms.
